iMEGA has said that the UIGEA infringes upon basic constitutional rights and that criminalization of financial transactions can be illegal in some instances.

Earlier this month, though Judge Mary L. Cooper of the U.S. District Court for the District of New Jersey dismissed the overall case, she countered a major government challenge to iMEGA’s suit by ruling that iMEGA did indeed have “legal standing” to pursue challenging UIGEA further, which was a strategic victory (click here for related article).
Commenting on important elements within the ruling, Eric M. Bernstein, Esq., attorney for iMEGA noted that “Judge Cooper’s ruling holds that, even with the passage of UIGEA, online gambling is only illegal in states where a statute specifically says it is.” Joe Brennan Jr., the chairman of iMEGA noted another significant aspect of the ruling, saying, “Judge Cooper found that banks, credit card companies and other payment system instruments are exempt from criminal sanctions under UIGEA, significantly undercutting UIGEA’s enforcement mechanism. Her ruling echoes the growing consensus of opinion that UIGEA is a fundamentally flawed statute.”
iMEGA’s recent filing is only the first step in the appeals process for its case against the UIGEA.

Anthony Lellouche finished in second place for $779,215. Mercier had a big chip lead entering heads-up play, and the heads-up battle only lasted two hands. The two players got all of their chips in the middle with Lellouche holding a pair of sevens and Mercier holding K-Q offsuit. The flop was a great one for Mercier as it came A-Q-4 with two spades, giving him middle pair and the highest spade in case running spades came on the turn and river. The turn and river ended up being the harmless 8 and 2 of clubs, and Mercier secured the victory.
Dario Minieri, who gained fame at last year’s World Series of Poker main event, entered the final table as the chip leader but finished in third place for $443,767. He was eliminated by Mercier.

Vicente Perez, 57, of Georgia, began arguing with another man at a Taj poker table, Vitale said. They stepped out of the casino and into the valet parking area of the garage near the Virginia Avenue entrance, where the argument descended into violence.
The victim, whose identity was not released pending the notification of his family, was pronounced dead at 4:05 p.m. at AtlantiCare Medical Center in Atlantic City.
Perez is in custody and faces charges of aggravated manslaughter and two weapons charges.

This week, Florida’s poker expansion bill, sponsored by Senate Minority Leader Steve Geller, passed the Florida Senate committee with an 8-2 vote. It paves the way for high-stakes and celebrity tournaments at parimutuels. It would also expand gaming to 18 hours a day on weekdays and 24 hours a day on weekends, reports the Miami Herald. Current law allows card rooms to operate for no more than 12 hours a day.
The bill would also allow parimutuels to host and broadcast celebrity or charity poker tournaments like the ones that have become television mainstays in recent years. They could also have high-stakes tournaments in which up to 1,000 players each pay up to $10,000 in entry fees.
Mississippi is concerned about its gambling industry — nearly a quarter of the visitors to its casinos came from neighboring Florida last year. That could mean a loss in revenue of up to a quarter of a billion dollars for Mississippi, according to the story.
Mississippi’s legislature is now considering a bill that would give tax breaks for casinos that build attractions for non-gamblers.
