Poker News - Canadian poker players receive discharges

Canadian poker players receive discharges

According to a story with the Winnipeg Free Press both Neil Faderson, 27, and Rellen Orcullo, 34, pleaded guilty and were subsequently handed discharges meaning they will keep clean criminal records.

Approximately 60 officers raided cash games around the city on May 31 last year. Police shut down illegal games at the Bari Club on Corydon Avenue and the Barca Club on McMillan Avenue. Fifty-seven people were charged for being present in common gaming houses.

More than 50 of those charged will receive similar discharges to Faderson and Orcullo after agreeing to enroll in a "positive lifestyles" program at the Salvation Army.

A select few have opted to fight their charges at trial dates which are now set for 2009. Each one has decided to appear with out lawyers and represent themselves in court.

Originally justice officials sent out a letter to all the accused last Fall that outlines their various options. Some were offended by the suggestion they take a course that includes a section on problem gambling because they feel it would be akin to admitting they did something wrong. Many in the poker community were outraged by the police raids.

In Manitoba, poker games have to be licensed by the Manitoba Gaming Control Commission and only certain groups such as charities or churches are able to claim proceeds.

m_mcdonald.jpgIn a series of comments to Canadian newspapers following his big EPT win last week, Mike ‘Timex’ McDonald sounded more like a PSA than an EPT champ - which is probably a good thing for the image of online poker players.

McDonald was profiled in an Orleans Star article following his EPT win. Excerpt:

But the Waterloo, Ont., card shark - who is the youngest poker player to ever win a top-level European tournament - said he has years of experience under his belt despite his young age, and is urging the dreamers to accept reality.

“Realistically, there are a lot more failure stories than there are success stories,” McDonald said Tuesday in an interview from Waterloo, hours after he arrived home from his big win.

“For the vast majority of people, staying away from poker is probably best.”

Nesson to speak at London seminar Tuesday

The seminar, titled "The Bush Administration's Criminalization of Online Gaming and the Implications for Global Free Trade" hosted by the Institute of Economic Affairs, will focus on the actions of the current presidential administration towards the overseas companies that offer online gaming and poker.

It is free for the public to attend and will take place at 6:30 p.m. (London time) in The Arthur Seldon Room, at 2 Lord North Street, Westminster, SW1 (door on Great Peter Street.).

People interested in attending are asked to RSVP to IEA Reception by emailing iea@iea.org.uk.

Professor Nesson will be joined by several prominent and knowledgeable members of the trade community. He will sit beside Dr. Sallie James, a Policy Analyst at the Center for Trade Policy Studies and the Cato Institute, and Lode Van Den Hende, a Senior Associate of Herbert Smith LLP, based in Brussels, specializing in E.U. competition and regulation.

The seminar will be chaired by John Blundell, the Director General and Ralph Harris Fellow of the IEA.

Some of the subjects that will be covered are those that Professor Nesson has discussed previously in his writings on the GPSTS website (gpsts.org) and on popular television shows such as Comedy Central's The Colbert Report.

The ongoing trade dispute between the U. S., the European Union and several other countries will be at the forefront with additional discussion on the latest developments in ongoing challenges to the Unlawful Internet Gaming Enforcement Act, enacted by President Bush in 2006.

Other subjects that will be broached include:

  • the complaint filed by the Remote Gambling Association in December 2007 with the EC against the United States for discrimination based on violations of WTO rules, asserting that the U.S. Department of Justice is in violation of international law by threatening and pressing criminal prosecutions and other actions against foreign online gaming operators while allowing domestic U.S. gaming operators to flourish,
  • Costa Rica's recent January challenge in the WTO regarding the UIGEA (which could unravel the agreement that was reached between the U. S. and the E. U.)
  • the implications on global trade

Professor Nesson, for his part, sees the problems that the UIGEA has brought and the problems that are associated.

"The conflict between the U. S. government and the online community over online poker and other forms of betting will not go away. There is growing concern about its impact on global trade, domestic U.S. law, and Internet freedom and regulation," he said.
